Turkey: Kurdish Politicians Unfairly Convicted in a Mass Trial
On May 16, 2024, a Turkish court convicted 24 Kurdish politicians on false charges of crimes against the state. The politicians were members of the opposition party Peoples’ Democratic Party (HDP), including former co-chairs Selahattin Demirtaş and Figen Yüksekdağ. This court ruling highlights the misuse of the criminal justice system by the Turkish authorities to unjustly detain these politicians and remove them from political life. The sentencing of these politicians, ranging from 9 to 42 years in prison, is seen as a move to stifle Kurdish representation, undermine democracy, and criminalize political speech.
The Ankara 22nd Assize Court sentenced Selahattin Demirtaş to 42 years in prison, Figen Yüksekdağ to 30 years, and other politicians to varying prison terms. The trial, known as the “Kobane trial,” stemmed from social media posts and political speeches made by the HDP regarding protests in 2014. The prosecution added statements from anonymous witnesses to the case file, leading to unsubstantiated allegations against the politicians. The court's verdict has been criticized for violating fair trial guarantees and relying heavily on social media posts as evidence against the politicians.
The crackdown on the pro-Kurdish rights HDP has been attributed to President Recep Tayyip Erdoğan’s ruling party in coalition with the far-right Nationalist Action Party. The persecution of Kurdish politicians intensified after the breakdown of peace efforts between the PKK and the Turkish state in 2015. The subsequent arrests of HDP members, including leading MPs and elected mayors, have led to a sustained campaign of political repression. Demirtaş and Yüksekdağ, the former co-chairs of the HDP, have been imprisoned since 2016, despite calls for their release from the European Court of Human Rights.
The sentencing of Demirtaş, Yüksekdağ, and other opposition politicians has raised concerns about the state of human rights, rule of law, and democracy in Turkey. The blatant disregard for international human rights standards and ECtHR judgments in the treatment of these politicians highlights the urgent need for action from the international community. The continued detention and sentencing of these politicians for their political advocacy for Kurdish rights undermine hopes for positive change in Turkey and risk further deterioration of human rights in the country.
The international community faces a critical choice in responding to the human rights violations in Turkey. By remaining silent, there is a risk of complicity in repressive practices, while speaking out and taking robust action can help hold Turkey accountable for its breaches of international obligations. The unjust conviction of Kurdish politicians exemplifies the ongoing struggles for democracy, freedom of expression, and political representation in Turkey, highlighting the need for greater international engagement to protect human rights in the country.
